1. 1. Acceptance of Terms
By creating an account or using Refervia, you agree to these Terms of Service. If you do not agree, please do not use the platform.
If you use Refervia on behalf of a company, agency, brokerage, or team, you confirm that you have authority to accept these Terms for that organization.
These Terms are provided by PureCrest Enterprises Inc., the company that operates Refervia.
2. 2. About Refervia
Refervia is a referral handoff platform for real estate agents, insurance professionals, agencies, brokerages, and teams. It helps you invite trusted partners, send and receive organized referral handoffs, track referral status, and coordinate work with the people you already trust.
Refervia is software that helps you organize and coordinate referrals. Refervia does not guarantee referral outcomes, policy placement, closings, commissions, compensation, conversions, or any client decision.
You and the professionals you work with are responsible for the substance of every referral and for any relationship or transaction that follows from it.
3. 3. Eligibility
You must be at least 18 years old and able to form a binding contract to use Refervia.
Refervia is intended for professional use by real estate, insurance, and related professionals and the organizations they work with.
4. 4. Account Registration
To use most features, you need to create an account with accurate information and keep it up to date.
You are responsible for keeping your login credentials secure and for activity that happens under your account. Please tell us promptly if you believe your account has been accessed without permission.
5. 5. Individual and Organization Accounts
Refervia supports individual accounts and organization accounts.
- Individual plans include Free and Pro tiers for solo professionals.
- Organization plans include Brokerage, Agency, and Enterprise tiers for teams.
In an organization account, admins can invite team members, and invited members accept to join. Admins manage roles and permissions for their organization.
The features available to you depend on your plan and the permissions your organization has assigned.
6. 6. Trusted Partner Invites
Refervia lets you invite trusted partners so you can send and receive referral handoffs with people you choose.
An invited partner must accept before a connection is created. The relationship between you and your partners exists outside of Refervia, and you decide who to invite and work with.
Refervia does not guarantee the performance, responsiveness, availability, or results of any partner you connect with.
7. 7. Team Referral Queue
Eligible organization accounts may have access to a Team Referral Queue, an internal workflow that helps a team route and manage referral handoffs among its own members.
The Team Referral Queue is an internal tool, not a public invite flow. Within it, authorized members can claim, assign, and manage internal handoffs.
Access to the Team Referral Queue depends on your plan and the permissions set by your organization.
8. 8. Partner Quality Signals
Refervia offers Partner Quality Signals such as labels, notes, and signals to help you manage your own referral relationships.
These signals are private relationship tools. Private labels and notes are kept at the account or organization level and are meant for your internal use.
You agree not to use these features for defamation, harassment, public shaming, or unlawful discrimination. Refervia does not verify, certify, or rate the quality of any partner.
9. 9. User Responsibilities
When you use Refervia, you agree to:
- Provide accurate information and keep your profile current.
- Act professionally and honestly with your partners and contacts.
- Comply with all laws that apply to you, including licensing requirements.
- Follow the rules of your carriers, brokerages, employers, and any professional bodies you belong to.
- Obtain proper client consent before submitting client or contact information.
- Handle sensitive personal information carefully and only when you are authorized to do so.
- Avoid any misuse of the platform or its features.
10. 10. Referral and Compliance Limitations
Refervia is workflow software only. It is not legal, insurance, real estate, tax, financial, or compliance advice.
You are responsible for deciding whether and how you may send, receive, or act on any referral under the laws and rules that apply to you.
If you are unsure whether a referral arrangement is permitted, please consult qualified counsel or a compliance professional before proceeding.
11. 11. Payments and Subscriptions
Paid plans are billed through Stripe, our payment processor. Refervia does not store raw card details.
Some plans may include referral limits or other usage limits based on your tier.
Refervia's current public plans are subscription-based and do not charge per-referral fees.
You can cancel your subscription at any time in your billing settings.
Cancellation and refund policy: cancellations take effect at the end of your current billing term. When you cancel, your subscription simply stops renewing, and you keep full access for the remainder of the term you have already paid for. Refervia does not provide refunds or prorated credits for the current term, including for partial periods or unused time. Fees are billed in advance and are non-refundable except where a refund is required by law.
12. 12. Plan Changes
You may upgrade or downgrade your plan subject to the options available in your account.
Changes to features, limits, or pricing may apply at the start of your next billing cycle. We will provide notice of material changes where required.
13. 13. Acceptable Use
Your use of Refervia is subject to our Acceptable Use Policy, available at /acceptable-use.
Violating that policy may result in suspension or termination of your account.
14. 14. Data and Privacy
Our Privacy Policy, available at /privacy, explains how we collect, use, share, and protect information.
By using Refervia, you acknowledge that information may be visible to the professionals or organizations involved in a referral workflow.
15. 15. Third-Party Services
Refervia relies on third-party services to operate, including Stripe for payments, analytics providers, email providers, hosting providers, and other integrations.
These services have their own terms and privacy practices. Refervia is not responsible for the acts or omissions of third-party providers.
16. 16. Beta and Early Access Features
Some features may be offered as beta, early access, or experimental. These features may be incomplete and subject to change or removal.
Beta features are provided as is, and we may adjust or discontinue them as we improve the platform.
17. 17. No Guarantees
Refervia helps you organize and coordinate referrals, but it does not guarantee any result. In particular, Refervia does not guarantee:
- Referral volume.
- Referral quality.
- Client contact.
- Client conversion.
- Policy issuance.
- Any real estate closing.
- Partner response.
- Revenue.
- Compliance suitability for your situation.
18. 18. Limitation of Liability
To the fullest extent permitted by law, Refervia and PureCrest Enterprises Inc. are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business, arising from your use of the platform.
19. 19. Indemnification
You agree to defend and indemnify PureCrest Enterprises Inc. against claims, losses, and expenses arising from your use of Refervia, your referrals, or your violation of these Terms or applicable law.
20. 20. Termination
You may stop using Refervia at any time. We may suspend or terminate access if you violate these Terms, misuse the platform, or create risk for other users.
Some provisions, such as limitation of liability and indemnification, continue to apply after your account ends.
21. 21. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date and provide notice where required.
Continuing to use Refervia after changes take effect means you accept the updated Terms.
22. 22. Governing Law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules.
